These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “user,” or “you”) and Carie Giroux Coaching (“Company,” “we,” “us,” or “our”) governing your access to and use of our website located at https://cariegiroux.com (the “Website”) and any products, services, or content provided through or in connection with it (collectively, the “Services”). By accessing or using our Website or Services, you agree to be bound by these Terms.
1. Definitions “Company,” “we,” “us,” “our” – Carie Giroux Coaching, the service provider. “Website” – The website located at https://cariegiroux.com. “Services” – All coaching, workshops, programs, digital products, and offerings provided by Carie Giroux Coaching. “User,” “you,” “your” – Any individual who accesses or utilizes the Website or Services. “Parties” – Collectively, Carie Giroux Coaching and the user.
2. Use of Website You may use our Website solely for lawful, personal, and non-commercial purposes and in accordance with these Terms. You agree not to:
Violate any applicable laws or regulations;
Use the Website for spam or unsolicited commercial messaging;
Interfere with or disrupt Website operations or security;
Attempt to access restricted areas of the Website or our systems without authorization.
3. User Accounts If you create an account, you agree to:
Provide accurate, up-to-date information;
Keep your login credentials confidential;
Take full responsibility for activity under your account. We reserve the right to suspend or terminate your account for any violation of these Terms.
4. Coaching Services Disclaimer Coaching is a collaborative, forward-focused process that supports personal and professional development. It is not a substitute for therapy, counseling, or medical treatment. You acknowledge that:
You are solely responsible for creating and implementing your own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and your coaching calls and interactions with the Coach. As such, the Coachee agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
Coaching does not treat or diagnose mental disorders as defined by the American Psychiatric Association and is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals.
No specific outcomes or results are guaranteed.
5. Service Offerings Current services may include:
Personalized Coaching: Private virtual sessions.
Group Coaching: Virtual sessions.
Workshops: Topic-specific sessions offered periodically. Please refer to each offering's description for full details before purchasing.
6. Rescheduling and Cancellation Policy We aim to maintain fairness and consistency across all client interactions. The following policies apply to private coaching sessions:
Notice Requirement: It is the Coachee's responsibility to notify the Coach more than 12 hours in advance of the scheduled calls/meetings. Sessions may be rescheduled with at least 24 hours’ notice prior to the scheduled time. Requests made less than 24 hours in advance may result in forfeiture of the session.
Rescheduling Limits: Each prepaid session may be rescheduled once. The rescheduled session must be completed within 30 calendar days of the original appointment, or it will be forfeited.
Emergencies: In the event of a serious emergency (such as health, family emergency, weather, or a particularly stressful day), additional flexibility may be offered at the sole discretion of the Company. We ask that you provide courteous notification via phone call or text as soon as possible if such a circumstance arises.
7. Fees and Payment Payment is required in full at the time of purchase unless an installment plan is explicitly offered and agreed upon. Payments are securely processed via third-party platforms. Failure to complete payment may result in suspended access to Services.
8. Privacy and Confidentiality Your personal data is handled in accordance with our Privacy Policy. Confidentiality is essential to our coaching relationship. We will not disclose any information pertaining to the Coachee without the Coachee’s written consent, except:
When required by statute, lawfully issued subpoena, or by court order to disclose;
If the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Coachee or others;
If the information involves illegal activity;
For professional verification purposes (your name, contact information, and start and end dates of coaching may be shared with staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship; no personal notes will be shared);
For professional development purposes, where topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and/or consultation purposes. Please note that the Coach-Coachee relationship is not considered a legally confidential relationship (like the medical and legal professions), and thus communications are not subject to the protection of any legally recognized privilege. We encourage sensitive matters to be discussed during sessions, not over email or text.
9. Intellectual Property All content provided through the Website and Services—text, visuals, branding, materials—is the property of Carie Giroux Coaching or its licensors. You may not copy, share, modify, or republish any content without written permission.
10. Third-Party Links We may include links to third-party websites for your convenience. We are not responsible for their content, services, or accuracy. Accessing these sites is at your own risk.
11. Disclaimer of Warranties Except as expressly provided in this Agreement, the Coach makes no guarantees, representations, or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon, and rendered. We do not guarantee uninterrupted or error-free service or that the Website will be free from viruses or harmful components.
12. Limitation of Liability To the fullest extent permitted by law, Carie Giroux Coaching shall not be liable for any indirect, consequential, or special damages, including lost profits, business interruption, or data loss resulting from use of the Website or Services. Notwithstanding any damages that the Coachee may incur, the Coach’s entire liability under this Agreement, and the Coachee’s exclusive remedy, shall be limited to the amount actually paid by the Coachee to the Coach under this Agreement for all coaching services rendered through and including the termination date. Your sole remedy is to discontinue use.
13. Indemnification You agree to indemnify and hold harmless Carie Giroux Coaching, its agents, and affiliates from any claims, losses, or expenses arising out of your violation of these Terms or misuse of the Services.
14. Termination of Coaching Relationship Either the Coachee or the Coach may terminate this Agreement at any time with one week written notice. You agree to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship. Any unused sessions not taken will be refunded in full if the Coachee or coach terminates the agreement before the sessions are completed.
15. Governing Law These Terms are governed by the laws of the State of New Jersey, United States, without giving effect to any conflicts of laws provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Hunterdon County, New Jersey.
